Rechtssatz

Verletzungen von Vorschriften über die Fragestellung stellen auch dann den speziellen Nichtigkeitsgrund nach Z 6, nicht aber den der Z 5 des § 345 StPO dar, wenn ein die Fragestellung betreffender Antrag einer Partei vom Schwurgerichtshof abgewiesen wird (SSt VI/132).
