Das BVwG ist nicht zuständig, eine Feststellung gem § 331 Abs 1 Z 2 BVergG 2006 hinsichtlich einer allenfalls nicht entsprechenden Vorinformation gem Art 7 Abs 2 PSO-VO zu treffen. Für eine solche Feststellung sind die Zivilgerichte zuständig.
