In the last decade, the Netherlands attracted widespread attention with its successful 2005 Act ('WCAM') which facilitates collective settlement of mass damage. Now, the Dutch are about to take collective redress to a 'next level'. A new piece of legislation will introduce, on top of the existing framework, a procedure for mass damages compensation. But is it really an improvement?
