Clean air quality is not only important for the environment, but also for each individual, as it plays a major role in health and quality of life. It is therefore of crucial significance for the realization of ‘Green Justice’ in Europe. However, ‘Green Justice’ is not only achieved through legislation, but above all through its effective enforcement. The recent judgement of the European Court of Justice on air quality and the role of State liability leads to the question of the extent to which there is a ‘right to clean air’ and how this can be enforced.
