5.1 Invalidation
5.1.1 Absolute and relative grounds
Pursuant to art 46 para 1 of the Law on Trademarks, upon the request of any interested person, the registration of a trademark may be invalidated by the court on absolute grounds for refusal (cf. sec 3.5 above) as well as relative grounds for refusal (cf. sec 3.6 above).
Declaration of invalidity of the registration of a trademark shall mean its invalidity ab initio, i.e. as of the day of application for registration29.
