5.1 Non-use
Once a proprietor has registered the trademark, he must use it or he may lose protection even before the expiration of the 10 year period set forth in Article 43 of the Trademark law. Trademark protection can also be lost before the end of this period if it is used, but not used properly (Article 9.1(c)). Both the non-use and improper use can give rise to revocation of the trademark registration, and may also be used as defences against trademark infringement allegations in court proceedings.
