5.1 Declaration of invalidity
According to sec 52 para 1 Trade Marks Act, an interested person may file an action for declaration of invalidity of a trademark against its proprietor. Such an action can be based on absolute or relative grounds for refusal specified in sec 9 or sec 10 Trade Marks Act. The grounds for the action must have existed at the time of registration of the trademark.
