4.1 Scope of Protection
From the time the trademark is registered, all effects of the trademark accrue. The applicant becomes the owner of the trademark. He is entitled to all of the rights connected with the trademark. Furthermore, he becomes entitled to sue for infringement of the trademark. The registration of a trademark is a constitutive act which leads to a stronger legal certainty. Sec. 8 Trademark Act corresponds to Art. 5 of the EC TM Directive and is in compliance with Art. 9 of the CTMR. Therefore, reference is made to the Chapter on the CTMR.
