A CTM may be transferred, separately from any transfer of the undertaking, in respect of some or all of the goods or services for which it is registered (Art 17 (1) CTMR). The assignment needs to be in writing and signed (Art 17 (3) CTMR). Evidence of transfer (a transfer agreement or deed) needs to be presented to OHIM for recordal in the Register. Such a document needs not be legalised, nor is it necessary to submit the original of the document (simple photocopies are sufficient). The Office will examine such documents only in respect of whether they actually prove what is indicated in the request, namely the identity of the marks concerned and the identity of the parties and whether a transfer is involved.122
