Rights in a trademark may be assigned independently of the transfer of the business in which the trademark is incorporated. An assignment deed shall be executed in writing and signed by the parties to the contract, under penalty of nullity. Assignments which are free of charge shall be notarised under the penalty of nullity of the form, in order to comply with the Romanian provisions required for the form of donation contracts.
