Property rights over the trademark could be used as a security in Ukraine and may be pledged. As to pending applications, it is arguable whether they can be an effective and valid instrument. The pledge becomes valid for the parties of the respective pledge agreement from the moment of its execution. The pledge has effect vis-à-vis third parties from the moment of its registration with the State Register of Encumbrances over Movable Property.
