Under Ukrainian trademark law, loss of protection relates to suspension of trademark protection in the future (ex nunc), which means that before the suspension, use of a trademark was lawful. In contrast to this, cancellation of a trademark relates to its unlawful registration (ex tunc), which means that the trademark is invalid from its registration.
The Trademark law provides for the following forms for the suspension of protection:
