As outlined above in Section 9, derogations allow the sanctioned person to use frozen funds for certain purposes. However, it needs to be distinguished between sanctioned persons making payments using frozen funds and
operators making payments to sanctioned persons. Art. 7 generally allows operators to make certain payments to
frozen accounts. Art. 7 is
not a derogation because
no authorization from the national competent authority is required if a payment by an operator falls under this provision.
