Rechtssatz

Das Judikat Nr 58 neu findet auch dann Anwendung, wenn das Berufungsgericht seine Entscheidung über die Nichtigkeitsklage oder Wiederaufnahmsklage den Parteien nicht im Wege des Erstgerichtes, sondern unmittelbar zugestellt hat.
