A. General rules on damages
The general civil law rules on damages provide following test:
Damage: Is there damage? If so, in what amount?Causality: Was the action or omission of person X causal for the occurrence of the damage? Or, also: Would the damage have occurred if one ‘thinks away’ the action of person X (‘conditio sine qua non’ test)?
