3.1 Owner
The Trademark Act prescribes that any natural or legal person may be the applicant of a trademark, respectively a holder of a trademark. Special attention has to be paid to whether the applicant has legal capacity (e.g., where the state administration bodies file an application, the applicant has to be the Republic of Croatia). Foreign persons (legal and natural persons) not having a principal place of business or a domicile or a habitual residence in a territory of the Republic of Croatia, shall, under the Trademark Act, enjoy the same rights as Croatian nationals, if they result from the international treaties binding the Republic of Croatia or from the application of the principle of reciprocity. However, different rules apply with respect to their representation before the Patent Office (see section 10.1 below).1
