4.1 Scope of Protection
Art 13 of the Bulgarian Trademark and Geographical Indications Act provides for the content of the exclusive rights conferred on the proprietor of a registered mark. Said provision corresponds to Art 5 EC TM Directive. The exclusive right shall be effective vis-à-vis third parties as from the date of publication of the registration. The Bulgarian case law follows the case law of the GC and CJ. Therefore, please refer to the chapter on CTMs (cf. section 4.1).
