The competence for the scrutiny of the legality of the cross-border merger is granted by the Company Law to the judge delegated with the Trade Registry office in which the Romanian companies participating in the merger are registered. The procedure is divided into the following main steps:
filing of the common draft terms with the competent Trade Registry (and publication in the Official Gazette; for further details please see above);
