4.1 Mandatory elements
The management board (the managing directors) of each of the merging companies is required to draw up the common draft terms of the cross-border merger. The common draft terms must include at least the following:
the type, name, identification number and registered office of the merging companies and those proposed for the company that emerges from the cross-border merger (except for the identification number);
