4.1 Scope of Protection
The exclusive rights conferred on the holder of a registered trademark correspond to Art 5 EC TM Directive. The Polish case law follows the case law of the GC and ECJ. Therefore, reference is made to the chapter on CTMs (cf. chapter 4.1).
4.1.1 Use of a trademark
According to the Industrial Property Law, by obtaining protection the owner obtains the right of exclusive use of a trademark for profit-making or conducting business in the entire Republic of Poland.
