​​4.1 Scope of Protection

The exclusive rights conferred on the proprietor of a registered trademark correspond to art 5 EC TM Directive. The Austrian case law follows the case law of the GC and ECJ. Therefore, phase also refer to the chapter on CTMs (cf. section 4).
