§ 278c Abs 2 StGB ist eine unselbständige Qualifikation, somit nicht erst strafrahmen-, vielmehr bereits strafsatzbestimmend. Daher ist sie Gegenstand einer Subsumtions-, nicht bloß einer Sanktionsrüge.
