Multilateral Agreement M318

under section 1.5.1.1 of ADRconcerning the carriage of gases of Class 2 in refillable pressure receptacles authorized by the United States of America Department of Transportation in relation to 1.1.4.2

Part 1: Import

Refillable pressure receptacles authorised by the United States of America Department of Transportation and constructed and tested in accordance with Part 178, Specifications for Packagings of Title 49, Transportation, of the Code of Federal Regulations accepted for carriage in a transport chain in accordance with 1.1.4.2 may be carried from the location of the temporary storage at the end point of the transport chain to the end user.

The consignor for the ADR carriage shall include the following entry in the transport document:

“Carriage in accordance with Multilateral Agreement M318 Part 1."

Part 2: Export of gases and empty uncleaned pressure receptacles

Refillable pressure receptacles authorised by the United States of America Department of Transportation and constructed and tested in accordance with Part 178, Specifications for Packagings of Title 49, Transportation, of the Code of Federal Regulations may be carried only for the purpose of exporting to countries which are not Contracting States/Parties of ADR provided the following provisions are met:

1. 1. The filling of the pressure receptacle is in accordance with the relevant requirements of the Code of Federal Regulations of the United States of America.
2. 2. The pressure receptacles shall be marked and labelled in accordance with Chapter 5.2 of ADR.
3. 3. The consignor for the ADR carriage shall include the following entry in the transport document:

   “Carriage in accordance with Multilateral Agreement M318 Part 2."

This agreement shall be valid until 1 June 2023 for the carriage on the territories of those ADR Contracting Parties signatory to this agreement. If it is revoked before then by one of the signatories, it shall remain valid until the above mentioned date only for carriage on the territories of those ADR Contracting Parties signatory to this agreement which have not revoked it.

Teil 1: Einfuhr

Vom US Department of Transportation zugelassene nachfüllbare Druckgefäße, die gemäß „Part 178, Specifications for Packagings of Title 49, Transportation, of the Code of Federal Regulations“ gebaut und geprüft und für die Beförderung in einer Transportkette gemäß 1.1.4.2 zugelassen sind, dürfen vom Ort der vorübergehenden Lagerung am Endpunkt der Transportkette bis zum Endverbraucher befördert werden.

Im Beförderungspapier für die ADR-Beförderung ist zu vermerken:

„Beförderung gemäß Teil 1 der Multilateralen Vereinbarung M318“.

Teil 2: Ausfuhr von Gasen und leeren ungereinigten Druckgefäßen

Vom US Department of Transportation zugelassene nachfüllbare Druckgefäße, die gemäß „Part 178, Specifications for Packagings of Title 49, Transportation, of the Code of Federal Regulations“ gebaut und geprüft sind, dürfen zum Zweck der Ausfuhr in Länder, die nicht Vertragsstaaten/Vertragsparteien des ADR sind, nur befördert werden, wenn die folgenden Vorschriften eingehalten werden:

1. 1. Die Befüllung des Druckgefäßes erfolgt nach den einschlägigen Vorschriften des „Code of Federal Regulations of the United States of America“.
2. 2. Die Druckgefäße müssen gemäß dem Kapitel 5.2 des ADR gekennzeichnet und bezettelt sein.
3. 3. Im Beförderungspapier für die ADR-Beförderung ist zu vermerken:

   „Beförderung gemäß Teil 2 der Multilateralen Vereinbarung M318“.

Diese Vereinbarung gilt bis zum 1. Juni 2023 für Beförderungen in den Hoheitsgebieten der ADR-Vertragsparteien, die diese Vereinbarung unterzeichnet haben. Wird sie vor diesem Zeitpunkt von einem der Unterzeichner widerrufen, so gilt sie bis zum vorgenannten Zeitpunkt nur für Beförderungen in den Hoheitsgebieten derjenigen ADR-Vertragsparteien, die diese Vereinbarung unterzeichnet und nicht widerrufen haben.

Die vorliegende Vereinbarung wurde von Österreich am 5. Juni 2019 unterzeichnet.

Weiters haben nachstehende ADR-Vertragsparteien diese Vereinbarung unterzeichnet:
